People often are confused as to what is a will versus a living will, and what each can accomplish. A living will is a health care directive that allows individuals to direct their future health care in the event of their incapacity. Vehicles of distribution of property at death can include wills, revocable living trusts, insurance trusts, qualified personal residence trusts, and other options. Contrary to popular belief, having a will in place does not allow for an estate to avoid the probate process.

A trust provides for how assets are to be distributed upon your passing. A revocable living trust allows one to retitle assets as the trustee of a trust and lets you control how your assets will be distributed. A properly funded trust can also avoid the probate process.
