Wisconsin Charitable Trust Lawyers

There are several types of charitable trusts and options available for clients who wish to provide for a charity.

A charitable trust attorney at Moertl, Wilkins & Campbell, S.C., can inform clients of the charitable trust options available for gifts during a giver's lifetime or posthumous gifts to charitable organizations.

A charitable remainder trust is one of the most common types of charitable planning trusts. An individual gifts assets to this trust and will receive a payment at least annually for his or her life or for a set period of time. At the individual’s death or at the conclusion of the trust term, the assets of the trust are distributed to the charity named in the trust.

In the year in which the trust is created, the individual gets a charitable deduction and at the individual’s death estate taxes are avoided on any of these assets being distributed to charity. If an individual has low cost basis assets, these assets can be directly gifted to this trust and capital gains tax avoided.
